The U.S. Citizenship and Immigration Services renew Form I-9, Employment Eligibility Verification after it is expired. The current Form I-9 in use is valid from early 2023 to late 2024. This means the span of the used Form I-9 is about two and half years. Once it is expired, the new version must be used by the employees.
If Form I-9 given to the employer is expired, it will be considered as a violation. Although there won’t be any penalties to the employee or the employer, it will be a technical violation due to expired Form I-9.
When is the Form I-9 expiration date?
The current Form I-9 employees required to fill out will be expired on 10/31/2024. The expiration date of Form I-9 can be seen on the upper right corner of the form.
My Form I-9 expired, do I need to fill out a new one?
Once you fill out Form I-9 and furnish your employer with it, you aren’t obligated to fill out a new one simply because it is expired. The expiration date refers to when Form I-9 is going to be filled out. If you switch jobs, you cannot use the Form I-9 you filled out in the past.
When is the deadline to file a Form I-9?
There is no specific deadline to fill out a Form I-9. When the employee is hired is what matters. All newly hired employees must file Form I-9 within three days of their hire.
Employee did not file Form I-9, what do I do?
If any of your employees haven’t filed Form I-9 within three days of their hire, tell them to fill out one and give it to you. If you’re given a Form I-9 after this, check the expiration date. If they do not comply, it will be a violation. During an inspection, the USCIS may impose penalties both to the employer and the employee. Naturally, this gives the employer the right to terminate the employee due to not producing a Form I-9.
