If a worker’s information matches DHS and SSA records, the case is automatically verified as employment-authorized either immediately or within 24 hours.If the information does not match, the worker receives a Tentative Non-Confirmation notice and has eight workdays to resolve any discrepancies with DHS and SSA. The worker has the right to contest any findings in the case, which could potentially overturn the original finding that he or she is ineligible to work in the United States.

Many companies choose to operate their own E-Verify system, but it can be difficult for a company to learn how to use the complicated system. It requires training one or more employees to interface with the federal database, and it can take several weeks for a company to get the login info needed to begin using the program. If a company does not have the time or manpower to manage its own E-Verify process, it can hire an E-Verify Employer Agent. These are private companies with an agreement with the Department of Homeland Security that allows them to handle the verifications on behalf of client employers.

E-Verify Enrollment

Employers enroll in the E-Verify program voluntarily, although some employers may be required to participate by federal law or state law. In addition, some federal contractors are required to use the program as a condition of receiving federal contracts. Once an employer enrolls in the program, they are assigned a unique client company ID number. This number, which consists of four to seven numerical characters, is located on the top of each page of the memorandum of understanding (MOU) and displayed when selecting “View” to the right of the client name. The MOU is an agreement between the employer and E-Verify that establishes the terms of participation.
