The FMLA requirements for the employer are pretty straightforward. As the employer can operate in the private sector, it can also be a public agency or school employer. If you are a private sector employer, you need to have at least 50 or more employees who have been working for you for more than 20 weeks.

In addition, public agencies are directly covered by the FMLA and do not have to meet any requirements. This also applies to local educational agencies such as public school boards, private elementary and secondary schools, and public elementary and secondary schools.

Once the employer meets the requirements, the employer will be counted as an FMLA employer even though the number of employees will decrease during the year. However, the employer will be expected to meet the requirements again in the next calendar year.
